Objection to Release of Student Data – Due April 1, 2016

The California Department of Education is currently engaged in litigation with two nonprofit associations representing parents and guardians of children with disabilities.  As part of the ongoing case, a court has ordered CDE to produce confidential student information related to students who have attended California schools since Jan. 1, 2008.  This order may result in a release of your student’s confidential information.  To object to this release of information, parents must fill out and mail an objection form to the court no later than April 1, 2016.  The form and further information is available in both English and Spanish on the CDE’s website at cde.ca.gov/morganhillcase

The court has said that it will not provide the student data to the plaintiffs unless it determines that plaintiffs have the ability to secure it, according to State Superintendent of Public Instruction Tom Torlakson. In addition, if the court does decide the student data should be produced by the CDE and turned over to the plaintiffs, it will only be available to the parties, their consultants and the courts.

The Long Beach Unified School District is not a party to the litigation and does not plan to disclose such data.  Questions may be directed to the CDE at 916-319-0800.
